As the only child of two concentration camp survivors, I learned early and viscerally how the erosion of checks and balances and the rise of unaccountable executive power are not abstract historical footnotes—they are direct threats to freedom and democracy. What happened in 1930s Germany, where the separation of powers was systematically dismantled (through acts like the Reichstag Fire Decree and the Enabling Act) paving the way for tyranny, serves as a stark historical warning. It reminds us why the safeguards in our own U.S. Constitution are so critical.
That's why recent events surrounding the creation and operation of the Department of Government Efficiency (DOGE), particularly the role assumed by Elon Musk, demand our immediate attention. This isn't just a Beltway issue; it's a direct challenge to the living framework protecting our rights, and it has serious potential consequences right here in California.
Central to this framework is the Appointments Clause (Article II, Section 2) of the Constitution. It mandates that principal officers wielding significant governmental authority must be confirmed by the Senate. This isn't mere procedure; it's a fundamental check carefully created by the framers to ensure accountability and prevent unelected, potentially conflicted individuals from concentrating power. When I heard reports that unelected individuals involved with DOGE gained access to the very Treasury systems processing Social Security and Medicare checks – checks millions of Californians rely on – this constitutional crisis wasn't abstract, it became deeply personal. This is personal to me because this sort of unauthorized co-opting of power is analogous to Hitler’s actions in the 1930s that we now know were part of a systematic effort to dismantle democratic institutions and consolidate total power. Through measures such as exploiting the Reichstag Fire, enacting the Enabling Act, and purging state institutions of their opponents, the Nazi regime not only transferred power to those loyal to its ideology but did so in a way that eradicated opposition and legal safeguards. It ultimately resulted in the execution of almost all of both of my parents’ relatives.
The Core Violation: Bypassing the Appointments Clause & Our Rights
The Constitution is clear: high-ranking officials with significant power need Senate confirmation. Establishing Musk's role at DOGE through executive action, without Senate scrutiny or consent, appears to directly violate this clause¹, ³ᵃ. Reports suggest he operates with the alleged power to reshape federal agencies, potentially influence vast sums of public money, and access sensitive systems – all without the public vetting and accountability that Senate confirmation guarantees.
Undermining Accountability: Senate confirmation is a public process. It allows potential conflicts of interest to be examined and ensures appointees commit to upholding the law and public trust. Bypassing this installs powerful figures accountable only to the executive, not to the people's elected representatives.
Eroding Separation of Powers: When the executive branch unilaterally appoints individuals to powerful roles, it encroaches on the Senate's constitutional duty, upsetting the careful balance designed to protect our rights. This is a steady breakdown of the rules that protect our democracy.
DOGE: A Case Study in Unchecked Power Affecting Californians
The actions reportedly taken under the DOGE banner illustrate the dangers:
Dismantling Agencies Without Oversight: The attempt to radically restructure USAID, including shutting down systems and placing senior staff on leave without congressional approval, shows how an unconfirmed appointee can disrupt vital functions². A federal court recognized the likely constitutional violations and temporarily halted these actions, but the threat remains.
Accessing Critical Payment Systems: Reports indicate Musk's team gained access to Treasury and OPM databases processing trillions in payments crucial for Social Security, Medicare, and federal salaries¹, ³ᵇ – payments essential to countless Californians. Placing such sensitive infrastructure under the potential influence of an unaccountable figure with vast personal business interests³ᵃ raises profound alarms, echoed by Senator Elizabeth Warren and others³ᵃ, ³ᵇ. This directly impacts the financial security and data privacy of Californians.
Creating a Parallel Power Structure: Internal memos and court filings suggest DOGE interfered with established procedures, personnel decisions, and funding outside normal channels, potentially violating the separation of powers and statutory controls⁴. This creates chaos and undermines programs Californians depend on.
This Isn't Just About One Billionaire – It's a Dangerous Blueprint
Empowering DOGE outside the constitutional framework isn't just about one individual. It establishes a dangerous precedent – a potential blueprint for future administrations to bypass Congress and install unaccountable "czars" to control government levers. History teaches us that such patterns threaten the democratic fabric itself.

This federal overreach isn't happening 'somewhere else'—it directly threatens California, potentially jeopardizing federal funding for programs like Medi-Cal and CalFresh, disrupting regulatory enforcement that protects our environment and workers, and undermining the constitutional rights of every resident.
